July 21st SOA Board Meeting

Following is the Agenda for the Somersett Owners Association (SOA) Board of Directors (Board) Meeting to be held at The Club at Town Center (TCTC) at 5:30 PM on Wednesday, July 21st in the Canyon View Room. Apparently Zoom video conferencing is not yet available from that location, so owner participation must be in person.

The Board Meeting Packet for the July 21st Board meeting was not yet available on the SOA website at the time of this posting. Therefore, SU is unable to provide any background info or comments on the individual agenda items at this time Given the two days to the Board meeting, perhaps one may still become available. For this, our readers are  referred to the SOA Documents/Board Documents/2021 page link on the SOA website (www.somersett.org), login is required.

Regarding the Committee Report agenda items (i.e., Budget & Finance, Communications, Strategic & Facilities, West Park Garden, and Community Events), SU suspects that these are simply place holders that may or may not be commented on. However, at the last Board meeting, two new committees were approved:1) a Technology Advisory Committee, and 2) a Strategic Planning Committee (separated out from the Strategic and Facilities Committee). Although not specifically identified on the agenda, perhaps an update on these two new committees will be provided.

Unfinished Business agenda items included: 1) legal Updates and 2) 1880 Dove Mountain (the saga continues). Again, SU suspects these are also placeholders with little new to report.

New Business agenda items include: 1) Guest Pass Discussion, 2) Variance for Basketball Hoops in Driveway Discussion, 3) Review of Insurance Proposals, 4) Review of Management Services Proposals, and 5) Acceptance of Streets and Gates in Cliffs From Toll Brothers. The latter two items should be of general interest to all owners. An action item of the ongoing “Management Options Study” was to solicit bids from other management companies in addition to FirstService Residential, perhaps some have been received, The last item pertains to a request for the SOA to accept turnover of the gates and streets at “The Cliffs at Somersett “ to the Association, even though home site development is far from complete. Not a good idea!

  1. I’m not sure what the holdup is on the Board packet, but I’ll check this morning. The Technology Review Committee is a subset of the Communications Committee and I suspect that their progress report will be combined with Communications. I know they’ve been busy.

    Updates for the study of the management of Somersett have been posted to the website, along with pertinent documents. Comprehensive reading there. There were 6 bids received for Management Proposals from outside firms. The financial aspects of those proposals were received as sealed bids and will be opened at the Board meeting.

    Toll Brothers has requested to turnover streets and curbs in the Cliffs in phases during their buildout and has offered an indemnity agreement to cover any damage in the interim. It’s an unusual request, driven by the fact that they pay for gates and snow removal while also paying full assessments on their lots. We’ve had our attorney review this and will be discussing appropriate actions at the meeting.

    I believe we have Zoom working upstairs now, so the meeting will be available in person or on Zoom.

    1. The Cliffs is possibly being built out in phases and they pay the lot assessments based on completion and turnover to homeowner. Another issue to consider is the coded gate access gate on the sidewalk adjoining the main entrance gate to The Cliffs. This is another issue of Open Access throughout Somersett. Toll Brothers has built many gated communities in Somersett and the sidewalks alongside these Entrance gates do NOT have gates installed. So why they chose to do this in The Cliffs is a big question, perhaps while construction was ongoing? The SOA should not accept handover of this phase of their project with the gate installed. No other gated communities within Somersett are closed access. Residents are already prevented from Open Access between The Pointe and Sierra Canyon, so the Board and lawyer must not allow this gate to be permanent.

  2. Why would we take on maintenance of roads throughout “The Cliffs”? That development is less than 50% built out and still sees heavy equipment traffic on a daily basis. Seems Toll Brothers is trying to lay the cost of subsequent repairs on the HOA, and the SOA board is willing to pony-up the $$$ when the roads need repairs. No HOA takes over before the build is complete, that’s just bad business.
    This smacks of a complete lack of thought on the part of the board…much like putting down 150,000sf of synthetic turf will eliminate the need to replace the irrigation system.
    Perhaps this is nothing more than the “Good ol’ boy” method of management, or perhaps we have finally become fully immersed in a state of insanity?

  3. I was conflicted on attending this Board Meeting in person (please bring back zoom)…and did not! Given the fact that even though vaccinated I could still catch the deadly Delta variant! – I would hate to be responsible for infecting an unvaccinated child at the TCTC… It was sad to read about the death of a healthy 30 year old unvaccinated man today from Delta!

    Instead, I was able to zoom into my San Francisco Board meeting – They decided to re-instate the mandatory mask policy, for all residents and visitors. Yes, they are prepared to “trust” that all unmasked folks were vaccinated, but did not feel without “verification”, that this would be workable. So masks are back to ensure safety of all in our building. (Shades of Ronald Reagan on nuclear reduction!)

    I note that finally (2 months ago), that the HOA map has been updated to more accurately reflect the current Cliffs layout… Unfortunately half the proposed development (according to the Toll plans submitted to the AGC) is omitted? Why?

    It seems very premature to allow Toll to turnover the Cliffs common area until all the roads have been built and most of the proposed houses constructed… I know they are anxious to divest themselves of their developmental responsibilities, just as we are anxious for them to complete their project.

    1. An Indemnity agreement is good…until you consider the SOA track record related to litigating these things
